CamPilot.ai
These End User License Agreement and Terms of Service ("Agreement") govern your use of the CamPilot.ai mobile application ("App") and related services ("Service") provided by CB Tech Services, LLC (d/b/a CamPilot.ai) ("Company," "we," "us," or "our"). The App is available on Apple iOS (via the Apple App Store) and Android (via Google Play Store).
By downloading, installing, or using the App, you agree to be bound by this Agreement. If you do not agree, do not use the App.
Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on mobile devices that you own or control, solely for your personal or professional use.
This license does not include the right to:
If you downloaded the App from the Apple App Store, Apple is not a party to this Agreement and bears no obligations with respect to the App. Apple has no responsibility to furnish maintenance or support services for the App, and in the event of any product liability claim, Apple has no warranty obligation. Apple is a third-party beneficiary of this Agreement and may enforce its terms against you.
If you downloaded the App from the Google Play Store, Google is not a party to this Agreement. Google bears no obligations with respect to the App or this Agreement.
Age. You must be at least 13 years old to use the App. If you are between 13 and 17, you must have permission from a parent or legal guardian. Parents or guardians who permit a minor to use the App accept responsibility for the minor's use and agree to this Agreement on the minor's behalf.
The App is not intended for children under 13. If we learn that a user is under 13, we will terminate their account and delete their data promptly.
Accounts. You may be required to create an account to use certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@campilot.ai if you suspect unauthorized access.

The App may allow you to capture or upload images and video for analysis and AI-powered processing. By using these features, you acknowledge and agree that:
The App and all content, features, and functionality (including but not limited to software, text, graphics, logos, and AI models) are owned by CB Tech Services, LLC (d/b/a CamPilot.ai) or its licensors and are protected by applicable intellectual property laws.
You retain ownership of any original content you capture or upload. By uploading content for processing, you grant us a limited, temporary license to process that content solely as necessary to provide the Service. This license expires when your content is deleted from our systems.
Certain features of the App may require a paid subscription or in-app purchase. All purchases are processed through the applicable platform (Apple App Store or Google Play Store) and are subject to their respective terms and refund policies. We do not directly handle your payment information.
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel subscriptions through your platform account settings.
THE APP AND SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. AI-generated analysis and recommendations are provided for informational purposes only and should not be relied upon as a substitute for professional judgment.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CB TECH SERVICES, LLC (D/B/A CAMPILOT.AI) OR ITS REPRESENTATIVES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP OR SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THIS AGREEMENT SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) $50 USD.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless CB Tech Services, LLC (d/b/a CamPilot.ai) and its representatives from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with (a) your use of the App; (b) your violation of this Agreement; or (c) your violation of any third-party rights.
We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. Upon termination, the license granted to you under this Agreement will immediately cease, and you must stop using the App and delete all copies from your devices.
You may terminate this Agreement at any time by uninstalling the App and deleting your account. Sections 6, 8, 9, 10, 12, and 13 survive termination.
This Agreement is governed by the laws of the State of Oregon, United States, without regard to conflict of law principles.
Binding Arbitration. PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS. Except for claims for injunctive or equitable relief or claims regarding intellectual property rights (which may be brought in any competent court without posting a bond), any dispute, controversy, or claim arising out of or relating to this Agreement or the App shall be settled by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction. The arbitration shall be conducted in English in Eugene, Oregon, or via remote proceedings. The arbitrator shall have the authority to award any remedy that a court of law could order or grant. Either party may seek emergency injunctive relief from a court of competent jurisdiction pending arbitration.
Class Action Waiver. YOU AND CB TECH SERVICES, LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, if the parties' dispute is resolved through arbitration, the arbitrator may not consolidate another person's claims with your claims and may not otherwise preside over any form of a representative or class proceeding.
Opt-Out Right. You may opt out of this arbitration agreement by notifying us in writing within 30 days of first accepting this Agreement. Send your opt-out notice to legal@campilot.ai with the subject line "Arbitration Opt-Out." Opting out does not affect any other provision of this Agreement.
Entire Agreement. This Agreement, together with our Privacy Policy and Data Deletion Policy, constitutes the entire agreement between you and CB Tech Services, LLC (d/b/a CamPilot.ai) regarding the App.
Severability. If any provision of this Agreement is found to be unenforceable, the remaining provisions will continue in full force and effect.
No Waiver. Our failure to enforce any right or provision of this Agreement will not be considered a waiver of those rights.
Changes. We may update this Agreement from time to time. We will notify you of material changes via the App or by email. Continued use of the App after changes constitutes acceptance of the updated Agreement.
